How to Switch Your FDA U.S. Agent
To switch FDA U.S. Agents, sign with the new agent first, then have your company's officer update the U.S. Agent field in FDA's registration system. FDA then asks the new agent to confirm. Food facilities must update the registration within 60 days of the change (21 CFR 1.234). Tell your old agent after the update is confirmed.
Steps
- Sign the new agent agreement
- Log in to FURLS (food, device), the ESG/CDER Direct (drug) or Cosmetics Direct (cosmetics)
- Replace the U.S. Agent name, address, phone and email
- Submit; the new agent confirms when FDA asks
- Give notice to the previous agent under their contract
Watch for
- Multi-year contracts or exit fees with the old agent: read the notice terms
- Old agents may notify FDA they no longer represent you, so update promptly
